The CACT Council is a key component of the CFTC’s efforts to create a regulatory regime that is accessible to all consumers, and it complements the CFTC’s existing consumer education and outreach efforts. Electronic trading and the Internet provide a number of opportunities for consumers, and in a similar fashion, electronic trading and the Internet also create new challenges for consumers and electronic data processors and intermediaries. A consumer’s interaction with an electronic data processor and the electronic trading system can be positive, negative, or neither. The CACT Council will enhance consumers’ understanding of the risks associated with the trading of financial instruments and encourage all electronic data processors and intermediaries to take proactive steps to develop risk-sensitive policies and practices in order to protect consumers. The creation of the CACT Council was prompted by the CFTC’s and NFA’s efforts to enhance consumer protection in the electronic trading environment, particularly in the event of trading account fraud or other irregularities. Accordingly, the CACT Council will work closely with the NFA’s Committee on the Automation of Trading and the NFA Trading Advisory Board. The CACT Council is composed of members who have demonstrated consumer-related expertise and who will provide guidance to the CFTC and NFA in regard to important issues and best practices. Over the course of the next six months, the CACT Council will be engaged in several activities designed to enhance the understanding of the risks associated with the trading of financial instruments and the extent to which electronic data processors and intermediaries are meeting their responsibilities as principal members of the financial marketplace. Members of the CACT Council will have the opportunity to participate in “CACT Forums” on consumer protection topics of interest to the CACT Council. These “CACT Forums” will be organized on a quarterly basis and will be held in cities around the country.
